These Terms of use (“Terms”) are the agreement between you and the operator of Levely (the “App”) for use of the App and the website at https://levely-app.com.

By creating an account or using the App, you agree to these Terms, our Privacy policy, and our Community guidelines. If you do not agree, do not use the App.

Purchases of Levely Premium are billed by Apple or Google, not by us. Those charges follow the store’s terms (Apple’s Standard EULA on iOS, Google Play Billing on Android). These Terms cover using Levely, not the store receipt.

1. Who we are

Levely is a fitness gamification app for Android and iOS. It turns real-world activity you authorize (steps, floors climbed, and sleep) into XP, levels, unlocks, challenges, and social competition.

Levely is not a medical device. It does not provide medical diagnosis, treatment, health or sleep advice, or workout coaching.

The operator of Levely is named in §17 Contact.

2. Eligibility

You must be at least 13, or the minimum age required to use online services in your country, whichever is higher. The App is not directed at children under that age.

You must be able to enter a contract. If you use the App for someone else, you are responsible for that use.

3. Your account

You need an account for sync, social features, and purchases. Create one with email and password, or continue with Google or (on iPhone) Apple. Apple may hide your email behind a private relay address; that still creates a Levely account, and it will not match an account you made with a different email.

You are responsible for the account. If you use a password, keep it secret. Tell us if you think someone else is using it.

Usernames are public. Other players can see them on profile cards, friends lists, challenges, and leaderboards. Username rules, filters, and resets are in the Community guidelines.

We may refuse a username, reset it, or close an account as described in these Terms and the guidelines.

You can delete the account in the App: Profile → Settings → Subscription, policies, delete → Delete account. Confirm with your password, or with Google / Apple if that is how you signed in. Deletion removes the Levely account from our primary systems as described in the Privacy policy. Deleting the Levely account does not cancel an Apple or Google subscription. Billing continues until you cancel with the store that charged you.

4. Health and fitness data

With your permission, Levely reads limited activity from the phone’s health store:

  • Android: Health Connect (step count, floors climbed, sleep duration)
  • iOS: Apple Health / HealthKit (step count, flights climbed, sleep analysis)

We do not need write access to change your health records for normal play.

When you are signed in, we sync day-level totals and related progression (XP, streaks, awards, challenge scores, season standings) to our servers so the game works across devices and with other players. Other players can see gameplay that is derived from that activity (for example challenge scores, leaderboard standings, and stats you pin on a profile card).

You can revoke health permissions in system settings at any time. That stops new reads. It does not by itself delete the account or past synced days.

You can pick preferred sources in Health & Metrics. We aim to ignore obviously manual samples where the platform lets us detect them. Do not feed the App fabricated activity to gain an advantage. That is cheating (see §8 and the Community guidelines).

5. Physical activity

Levely turns real walking, climbing, and sleep into a game. XP, awards, challenges, seasons, and leaderboards are not a workout plan, a medical recommendation, or a suggestion that any particular total is safe for you.

Some optional targets are extreme — including large single-day step or floor awards, and challenge numbers a host can set. Do not treat those as something you should attempt. Only do activity that is reasonable for your fitness. Stop if you have pain, dizziness, or feel unwell.

You decide how much you walk or climb. If you hurt yourself chasing a number in the App, that is not something we advised or prescribed. If you have a condition, are unused to long days on your feet, or are unsure, talk to a clinician first.

6. What the App includes

The free App includes, among other things: XP and levels from activity you sync; daily walk and climb challenges; awards and cosmetics from our catalog; friends; social challenges (including first-to, time-window, and last-man-standing modes); seasons and leaderboards; optional push notifications; and a referral / invite program.

Levely Premium is optional and paid. It may include, as shown in the App at the time you subscribe: a Premium profile presentation (including a gold mark and card styling); an extra emblem slot; lifetime / season stats on your own profile and optional pins on your card; weekly walk and climb on Home; streak restore on the terms shown in the App (today: restore the missed day, limited uses); hosting King of the Hill (people you invite play that mode free); extra season cosmetics you earn by playing (those stay after you cancel); and exclusive wardrobe items that you may wear only while Premium is active.

We may add, change, or remove features, cosmetics, seasons, awards, and modes. The App on the store listing is what you get that day, not a promise that every screen stays forever. If we add a new paid product, it will be sold through Apple or Google (or another method we disclose), and we will update these Terms and the Privacy policy if that change is material.

XP, levels, emblems, cosmetics, streaks, season rewards, referral rewards, and similar items have no cash value. They are a license to use inside the App while we operate it and while your account is in good standing. We do not pay out unused items. We may change catalogs, balance, or availability.

7. Levely Premium, payments, and cancellation

Premium is an optional auto-renewable subscription. Apple (iOS) or Google (Android) is the merchant of record. They handle charging, taxes, receipts, refunds, and cancellation. We do not see or store your card number.

Price, period, and any free trial or intro offer are whatever the store shows before you confirm. The subscription auto-renews until you cancel.

Cancel or change the plan in the store that billed you: in the App, Settings → Subscription, policies, delete → Manage subscription, or the Apple / Google subscription pages. Canceling stops the next renewal; you keep Premium until the period you already paid for ends, unless the store says otherwise.

Restore purchases is for people who already paid. It does not create a new charge.

Premium is tied to your Levely account, not to the Apple ID or Google account email. If you buy on one phone and sign in on the other, Premium can follow that Levely account. Manage and cancel still happen in the store that took the money.

Deleting the Levely account removes Premium from our servers for that account. It does not stop Apple or Google from charging you. Cancel in the store first if you do not want to keep paying.

Refunds: ask Apple or Google, not Levely. We cannot press a button that refunds a store charge.

If a subscription ends, Premium features turn off. Earned season cosmetics that we told you stay, stay. Wear-while-paying items unequip. The extra emblem slot clears; your other equipped emblems stay.

8. Fair play, referrals, and acceptable use

You agree not to:

  • cheat, fake, or inflate activity, XP, awards, challenges, seasons, or referrals
  • enter manual or fabricated health data to gain an advantage
  • tamper with the App, other players, or our services
  • harass, spam, or impersonate
  • use hate, sexual, or violent content in usernames or other text you create
  • scrape, overload, or probe the service in a way that harms it
  • create extra accounts or share a device to farm invite / referral rewards
  • use the App if we have banned the account

Invite rewards are for bringing people who play on their own. We may use activity patterns to keep those rewards fair.

9. User content

You may create limited text in the App (for example a username, an optional challenge name, a report note). That text must follow the Community guidelines.

You keep whatever rights you have in that text. You grant us a non-exclusive, worldwide license to host, copy, and show it inside Levely so the feature works (other players can see a username or a challenge name). We do not claim we can sell your username as a poster without asking.

We may remove or change content that breaks these Terms or the guidelines.

Do not post anything you do not have the right to post.

10. Our content

The App, name, art, emblems, cosmetics, copy, and software are owned by us or our licensors. We give you a personal, non-transferable license to use the App for yourself, as the stores allow.

You may not copy, sell, reverse engineer, or wrap the App except where the law says you may.

11. Moderation

We may review reports and we may act on our own. Actions can include resetting a username, restricting features (for example invites or challenges), excluding an account from leaderboards, or banning the account.

A first username reset is not a ban. Serious or repeated breaches can mean losing access.

If an account is banned, we may show a reason on the banned screen. You can email us. We do not promise a particular outcome or a deadline.

Bans do not cancel store billing. Cancel Premium in the store if you do not want to keep paying.

12. Notifications and other services

Push notifications are optional. You can disable them in Settings or the OS.

The App may open system apps and links (Apple Health, Health Connect, store listings, these legal pages). Those have their own terms.

We use service providers listed in the Privacy policy (for example hosting, email, crash reports, subscription verification, store and health platforms, and invite links).

13. Availability

We aim to keep Levely running. We do not promise uninterrupted service, perfect sync, or that a particular award, season, or number will never be corrected if data or a bug was wrong.

Maintenance, outages, store or health-platform changes, and events outside our control can interrupt the App.

14. Changes

We may update these Terms. We will change the Last updated date. When a change is material, we will take extra steps as appropriate (for example in-app notice). If you do not agree, stop using the App and delete the account; cancel store billing separately if you subscribe.

We will not use a Terms update to start selling your personal data or to add advertising without also updating the Privacy policy so it is still true.

15. Disclaimers and liability

The App is provided as a hobby project on a commercially reasonable basis.

Nothing in these Terms limits rights you cannot waive as a consumer under the law of Norway or of your country, including mandatory rules on digital content and subscriptions. Store refunds and cancellations follow Apple or Google.

We are not liable for loss we could not reasonably foresee, or for loss caused by you (including cheating, a weak password, or revoking health permission and then expecting the same scores).

We are not liable for the health platforms, Apple, Google, or other third parties we do not control.

Where liability can be limited, our total liability for a claim about the App is limited to the amount you paid for Levely Premium in the 12 months before the claim, or 1,000 NOK, whichever is higher. That cap does not apply to death or personal injury caused by negligence, or to intent or gross negligence, or to anything else the law will not let us limit.

16. Governing law

These Terms are governed by the laws of Norway, except that if you are a consumer you also keep the mandatory protections of the country where you live.

If a court says a part of these Terms cannot be enforced, the rest still applies.
